My retail Career Platform Terms.
Effective Date: 19th January 2026
These Platform Terms (Terms) govern access to and use of the My Retail Career platform, website, applications, software, training products, recruitment services, candidate tools and related services (together, the Platform).
By accessing, registering for or using the Platform, you agree to be bound by these Terms.
If you are using the Platform on behalf of a business or organisation, you confirm that you have authority to bind that business or organisation to these Terms.
1. About My Retail Career
My Retail Career (MYRC, we, us or our) is a New Zealand-based retail recruitment, training, career development and SaaS platform.
The Platform may provide products and services including:
Retail job boards and job advertising services
Employer and Client accounts
Candidate accounts and candidate profiles
CV builder tools
AI-assisted job advertising and candidate matching tools
Recruitment support and commissioned recruitment services
Retail Ready training and employability programmes
Training modules, webinars and learning content
Candidate career resources and interview preparation tools
Applicant Tracking System (ATS) functionality
HR tools, templates and frameworks
Employer dashboards and hiring tools
Candidate matching and talent pool tools
Sponsored content, advertising and employer branding opportunities
Subscription-based services and premium platform features
Additional products or services introduced from time to time
2. Definitions
In these Terms:
AI Features means any artificial intelligence, machine learning, automated recommendation, summarisation, matching, drafting or decision-support tools made available through the Platform.
Candidate means any individual who accesses the Platform to search for jobs, create a profile, build a CV, undertake training, apply for roles or use candidate services.
Candidate Content means any information, CVs, application materials, profile information, training submissions or other content uploaded or submitted by a Candidate.
Client means any employer, hiring business, recruiter, organisation or other entity using the Platform to advertise roles, access recruitment services, use employer tools or otherwise engage with MYRC.
Client Content means any job advertisements, branding materials, business information, recruitment content or other material supplied by a Client.
Confidential Information means information that is confidential in nature and includes personal information, commercial information, platform information and non-public business information.
Fees means any fees, charges or subscription amounts payable to MYRC.
Platform means the MYRC website, applications, software, databases, recruitment tools, training products, ATS functionality, AI Features and related services.
Retail Ready means MYRC’s retail readiness, employability and training framework.
Services means all services and functionality made available through the Platform.
User means any person accessing or using the Platform.
3. Platform Services
3.1 General Services
MYRC may provide services to Candidates, Clients and other Users through the Platform.
The Platform may include current and future:
Recruitment services
SaaS and ATS functionality
Training and development products
Candidate management tools
Employer hiring tools
AI-assisted functionality
Learning and webinar services
Advertising and sponsorship opportunities
Digital resources and templates
Communication and messaging tools
3.2 Platform Changes
MYRC may:
modify or update the Platform;
introduce new products or features;
suspend or discontinue Services;
change functionality or availability; or
impose usage limits, at any time.
Where reasonably practical, MYRC will endeavour to provide notice of material changes.
4. Registration and Accounts
4.1 Account Registration
Users may be required to create an account to access certain Services.
Users must provide accurate, current and complete information when registering.
4.2 Account Responsibility
Users are responsible for:
maintaining the confidentiality of login details;
all activity occurring under their account;
ensuring account information remains current; and
restricting unauthorised access to their account.
Users must notify MYRC immediately if they become aware of any unauthorised access or security breach.
4.3 Eligibility
Users must be legally capable of entering into binding agreements.
MYRC may refuse, suspend or terminate any account at its discretion.
5. Client Terms
5.1 Job Advertising Services
Clients may use the Platform to advertise retail and related job opportunities.
Clients must ensure all job advertisements:
are lawful, accurate and genuine;
comply with applicable employment and anti-discrimination laws;
do not contain misleading, deceptive or offensive material;
do not infringe third-party rights; and
accurately represent the role being advertised.
MYRC may reject, edit, suspend or remove any job advertisement at any time.
5.2 Employer and Hiring Obligations
Clients are solely responsible for:
their recruitment decisions;
candidate assessments and hiring processes;
compliance with employment laws;
handling Candidate information lawfully;
maintaining appropriate security over candidate data; and
ensuring authorised users comply with these Terms.
MYRC does not guarantee:
candidate suitability;
hiring outcomes;
application volumes;
recruitment success; or
workforce performance.
5.3 Recruitment Services
Where MYRC provides recruitment or candidate sourcing services:
MYRC may introduce Candidates to Clients;
Clients remain responsible for all hiring decisions;
no guarantee of placement or retention is provided unless expressly agreed in writing;
additional recruitment terms or commercial terms may apply.
5.4 Candidate Data Restrictions
Clients must not:
scrape or harvest candidate information;
resell or disclose candidate data;
use candidate information for unrelated marketing;
retain candidate information longer than reasonably necessary; or
use candidate data unlawfully.
6. Candidate Terms
6.1 Candidate Services
Candidates may use the Platform to:
search and apply for jobs;
create profiles;
upload CVs and applications;
build CVs using MYRC tools;
access Retail Ready resources and training;
access webinars, guides and employability tools; and
communicate with Clients or recruiters.
6.2 Candidate Responsibilities
Candidates are responsible for ensuring all information they provide is:
accurate;
current;
lawful;
not misleading; and
not infringing third-party rights.
6.3 No Employment Guarantee
MYRC does not guarantee:
interviews;
job offers;
employment outcomes;
career progression; or
candidate suitability for any role.
6.4 Candidate Profiles and Talent Pools
Candidates acknowledge that:
their information may be shared with Clients where they apply for a role or consent to visibility;
Clients may review profiles, CVs and application materials;
MYRC may maintain talent pools or candidate databases;
Candidate profiles may remain visible until deleted or deactivated.
7. AI-Assisted Features
7.1 AI Functionality
The Platform may include AI Features including:
AI-assisted job ad drafting;
candidate and job matching;
CV suggestions;
candidate summaries;
interview guidance;
training recommendations; and
automated workflows.
7.2 AI Disclaimer
AI Features are support tools only.
MYRC does not guarantee that AI-generated outputs are:
accurate;
complete;
unbiased;
reliable; or
suitable for any particular purpose.
Users must independently review and verify AI-generated outputs before relying on them.
7.3 Hiring Decisions
Clients remain solely responsible for recruitment and employment decisions.
AI Features should not be relied on as the sole basis for hiring or employment decisions.
8. Retail Ready Training and Learning Services
8.1 Training Services
MYRC may provide:
Retail Ready training modules;
webinars;
employability resources;
interview preparation tools;
learning content;
certificates or completion records; and
other training or development services.
8.2 Training Access
Access to training content may:
be limited to a specified period;
require payment of Fees;
be subject to subscription terms; or
be modified or withdrawn by MYRC.
8.3 No Guarantee
Completion of training or Retail Ready programmes does not guarantee:
employment;
interviews;
promotions;
certification recognition; or
role suitability.
8.4 Training Intellectual Property
Training content, videos, materials, frameworks and resources remain the intellectual property of MYRC or its licensors.
Users must not copy, distribute, resell or commercially exploit training content without written permission.
9. CV Builder and Candidate Resources
9.1 CV Builder
The Platform may provide CV builder tools, templates and career resources.
Candidates remain responsible for reviewing all CV content before use or submission.
9.2 Candidate Content Licence
Candidates grant MYRC a non-exclusive licence to host, process, store, display and transmit Candidate Content for the purpose of operating the Platform and providing Services.
9.3 Template Ownership
CV templates, formatting tools and design elements remain the property of MYRC.
10. ATS and SaaS Services
10.1 Employer Tools
MYRC may provide Clients with:
ATS functionality;
candidate pipeline management;
reporting tools;
communication tools;
hiring workflows;
dashboards;
candidate notes and tagging functionality; and
integrations with third-party systems.
10.2 Authorised Users
Clients are responsible for:
managing authorised users;
user permissions;
user conduct;
access controls; and
security of account credentials.
10.3 Platform Availability
MYRC does not guarantee uninterrupted or error-free access to the Platform.
Availability may be affected by:
maintenance;
outages;
third-party providers;
integrations;
technical issues; or
events outside MYRC’s control.
11. Fees, Billing and Subscriptions
11.1 Fees
Clients and Users must pay all applicable Fees associated with Services used through the Platform.
Fees may include:
job advertising fees;
subscription fees;
recruitment fees;
training fees;
premium feature fees; and
advertising or sponsorship fees.
11.2 Billing
Fees may be charged:
monthly;
annually;
per listing;
per subscription;
per user; or
as otherwise notified.
11.3 Subscription Renewals
Subscriptions may automatically renew unless cancelled before the renewal date.
11.4 Payment Failure
If payment is not successfully processed, MYRC may:
suspend Services;
restrict account access;
remove listings; or
terminate subscriptions.
11.5 Fee Changes
MYRC may change pricing or subscription fees from time to time by providing reasonable notice.
12. Privacy and Data Handling
12.1 Privacy Policy
Personal information is handled in accordance with MYRC’s Privacy Policy and applicable New Zealand privacy laws.
12.2 Candidate Information
Candidates acknowledge that their information may be shared with Clients in connection with recruitment and hiring activities.
12.3 Overseas Providers
MYRC may use third-party technology providers, cloud hosting providers or software providers located in New Zealand or overseas.
12.4 Analytics and Platform Improvement
MYRC may use aggregated, anonymised or de-identified information for:
analytics;
benchmarking;
reporting;
AI training;
service improvement; and
platform development,
where lawful and appropriate.
13. User Conduct and Acceptable Use
Users must not:
misuse the Platform;
upload unlawful or offensive material;
post misleading or discriminatory job advertisements;
scrape or harvest data;
interfere with platform functionality;
attempt unauthorised access;
distribute malware;
reverse engineer software;
impersonate another person; or
use the Platform fraudulently.
MYRC may investigate suspected breaches.
14. Intellectual Property
14.1 MYRC Intellectual Property
All intellectual property rights in the Platform, including:
software;
ATS functionality;
training content;
frameworks;
videos;
workflows;
templates;
branding;
platform design;
databases; and
AI tools,
remain owned by or licensed to MYRC.
14.2 Client and Candidate Content
Clients and Candidates retain ownership of content they upload to the Platform.
Users grant MYRC the rights reasonably required to host, process, display and use such content for the operation of the Platform.
15. Third-Party Services and Integrations
The Platform may integrate with or rely on third-party services.
MYRC is not responsible for third-party:
software;
integrations;
hosting services;
payment providers;
communication tools; or
external platforms.
Use of third-party services may be subject to separate terms.
16. Warranties and Disclaimers
To the maximum extent permitted by law:
the Platform is provided on an “as is” and “as available” basis;
MYRC does not guarantee uninterrupted availability;
MYRC does not guarantee recruitment outcomes, training outcomes or hiring outcomes;
Users access and use the Platform at their own risk.
Nothing in these Terms excludes rights that cannot lawfully be excluded under New Zealand law.
17. Limitation of Liability
To the maximum extent permitted by law, MYRC will not be liable for:
indirect or consequential loss;
loss of profits;
loss of business opportunities;
loss of goodwill;
data loss;
recruitment outcomes;
employment decisions;
reliance on AI-generated content;
platform interruptions; or
third-party failures.
Where MYRC is liable, MYRC’s total liability will be limited to the Fees paid to MYRC in the six months preceding the relevant claim.
18. Indemnity
Users agree to indemnify MYRC against claims, losses, liabilities, costs or expenses arising from:
breach of these Terms;
unlawful conduct;
misuse of the Platform; or
infringement of third-party rights.
19. Suspension and Termination
MYRC may suspend, restrict or terminate access to the Platform where:
these Terms are breached;
payment obligations are not met;
security risks arise;
unlawful conduct is suspected; or
required by law.
Users may stop using the Platform at any time.
Outstanding Fees remain payable.
20. Changes to Terms
MYRC may update these Terms from time to time.
Continued use of the Platform after updated Terms take effect constitutes acceptance of the revised Terms.
21. Governing Law and Disputes
These Terms are governed by the laws of New Zealand.
The parties submit to the non-exclusive jurisdiction of the New Zealand courts.
Before commencing formal legal proceedings, the parties agree to attempt to resolve disputes through good faith discussions.
